GENERAL TERMS AND CONDITIONS OF SALE
1. COMPANY PURPOSE AND DETAILS
These General Terms and Conditions govern the online purchase of active tourism services, tandem paragliding flights and courses through the website valledebenasque.es, owned by:
David Blanco Torres (NIF: 77586080L),
with address at Plaza el Ral 25, Floor 5, 22466, Castejón de Sos (Huesca)
Registered in the Register of Active Tourism Companies of Aragon with the official code TA-HU-0279.
2. DELIVERY METHOD AND CONFIRMATION
Booking our activities does not involve the shipment of any physical product. Once payment is securely completed through our virtual gateway (SSL), the customer will immediately receive an automated email confirming the booking or the digital voucher purchased.
3. PRICES AND PAYMENT METHOD
All prices shown on the website are in Euros (€) and include applicable Value Added Tax (VAT). Payments will be made by credit or debit card through the secure payment gateway integrated into the platform.
4. SPECIAL REGULATION DUE TO METEOROLOGY (FORCE MAJEURE)
The practice of paragliding depends strictly on meteorological and aerological conditions.
The instructor pilot is the highest and only authority on board to decide if the weather conditions guarantee the total safety of the flight.
If the pilot cancels the activity due to weather safety reasons before takeoff, a new execution date will be agreed with the client.
If the client is not available for another date due to being on a temporary tourism basis, a full refund of the amount paid will be issued or a voucher with extended validity will be issued.
5. MANDATORY REQUIREMENTS FOR PARTICIPANTS
For technical and operational safety reasons related to the paragliding equipment, participation is subject to compliance with the following requirements:
Weight Limits:
The passenger's weight must be between a minimum of 35 kg and a maximum of 100 kg. The pilot may check the weight before the flight.
Health Status:
The client declares under their own responsibility that they do not suffer from serious heart conditions, epilepsy, physical injuries incompatible with the takeoff run, or are pregnant. Flying under the influence of alcohol or drugs is strictly prohibited.
Minors:
They must have express authorization signed by their parents or legal guardians on the day of the activity.
6. CANCELLATION POLICY, GIFT VOUCHERS AND WITHDRAWAL
Right of Withdrawal:
Pursuant to Article 103.l) of the General Law for the Defense of Consumers and Users, the 14-day right of withdrawal does not apply to leisure services if the contract stipulates a specific date or period of performance. Therefore, refunds for withdrawal are not permitted for reservations for fixed dates that have already been scheduled.
Gift Vouchers (Open Date):
Gift vouchers purchased without a fixed date have a 14-day withdrawal period from the date of purchase. After this period, no refund will be issued. Gift vouchers have a non-extendable validity period of twelve (12) months from the date of purchase.
Cancellations by the Customer:
The client may modify or cancel their reservation free of charge by giving at least 48 hours' notice. Cancellations made by the client with less than 48 hours' notice or failure to show up on the agreed date and time will result in the total loss of the reservation and the amount paid.
7. ACTIVITY INSURANCE
ValledeBenasque Paragliding School declares under its own responsibility that it has the current insurance policies required by Decree 171/2024, of October 23, of the Government of Aragon, which approves the Regulation of active tourism companies: * Civil Liability Insurance. * Assistance and Accident Insurance for participants.
8. COMPLAINT FORMS AND DISPUTE RESOLUTION
Official complaint forms from the Government of Aragon are available to users. Furthermore, in accordance with Regulation (EU) No 524/2013 and its subsequent updates, we inform you of the existence of official European mechanisms for alternative online dispute resolution in electronic contracts. Consumers can access these authorized dispute resolution bodies through the European Commission's official portal at: europa.eu
